BOSTON — Federal agents working out of Boston say they’ve taken custody of a Honduran man living in the country illegally despite the fact he’s already been deported three times and faces serious criminal charges.

According to U.S. Immigration and Customs Enforcement Boston, their ICE Enforcement and Removal Operations team took Juan Alberto Rodezno-Marin, 39, into custody last week.

Rodezno-Marin in 2022 was arrested in Massachusetts and charged with indecent assault and battery on person over 14, assault and battery with a dangerous weapon, masked armed robbery, and assault to rape.

“Mr. Rodezno will have his day in court, but he stands accused of some horrific crimes. Not only did he repeatedly break U.S. immigration laws, but he apparently presents a substantial threat to the residents of Massachusetts,” acting Field Office Director Patricia Hyde said in a statement.

According to ICE Boston, immigration authorities first encountered Rodezno-Marin in 2007, when he was found in the U.S. without authorization and was sent back to Honduras.

He was arrested for illegally reentering the U.S. twice more, in 2008 and 2009, and again sent back to Honduras, according to ICE.

Rodezno-Marin was arrested by police in Massachusetts in 2022, when he was initially charged over the alleged assault and masked robbery. ICE says they issued an immigration detainer but that it was ignored by the court. Massachusetts law forbids the state from holding a person over an immigration detainer.

“The Middlesex Superior Court in Woburn, Massachusetts, arraigned Rodezno March 9, 2023, for the offenses of indecent assault and battery on a person over 14, assault and battery with a dangerous weapon, masked armed robbery, and assault to rape. Middlesex Superior Court ignored the ICE detainer and released Rodezno back into the community Dec. 4, 2024,” ICE wrote in a Monday release.

According to ICE, Rodezno-Marin remains in their custody after he was arrested in Boston on January 22.

“ICE ERO Boston cannot tolerate illegal criminal threats to our neighborhoods. We will continue our mission to prioritize public safety by arresting and removing the illegal criminal elements from our New England communities,” Hyde said.
